COVID-19 - New Updates from David McGowan


Covid-19 Business Interruption Claims

Since my last communication the FCA has started the court procedure to ascertain a legal precedent as to whether some policies do or don’t offer any cover for loss of profit/income following the lockdown. The FCA have identified various insurer policies and submitted them to court with the premise that they think cover is valid and the insurers have filled their defence. If you are interested you can sign up for updates on the case which will automatically sent to your email address.

I would reiterate that we are able to put a claim to your insurers on your behalf if you feel that you may have cover, we will check your policy, give you some professional advice and then submit a claim on your behalf dependent on your instructions. We are minded to remind policy holders that you have a duty to submit claims within a reasonable time therefore we would not want you to be in a position where insurers decline your claim because it is deemed as time barred.

Returning To Work

More and more of us are returning to work. We have received some more advice on what to look out for and also important advice for employers to consider from the HSE. There are some specific trade issues that need to be considered when restarting work.

Working safely during the coronavirus outbreak - New guidance will help you keep workers safe (COVID secure) during the outbreak. 
 
The following guides will help you manage the risk from coronavirus in your business during this time:

•    Working safely during the coronavirus outbreak - This step guide will help you make your work and workplace COVID secure. It'll help you to manage the risk associated with re-starting or running your business during the outbreak.
•    Guidance to help employers, employees and the self-employed understand how to work safely during the coronavirus pandemic. - Guidance to cover different types of work, produced by the Department for Business, Energy and Industrial Strategy (BEIS).
•    The United Kingdom Lubricants Association have produced guidance on controlling the risks from metalworking fluids, particularly where production has been reduced or is going to be re-started, due to the risk that without proper checks, ill health could be caused.

Travel Insurance

The government is looking to open air corridors between countries which in turn opens up our ability to go abroad for either business trips or holidaying. I would point out that until the government air corridors are actually open their advice is not to travel unless it is essential. Travel insurance policies will not cover you if go against government advice, so you need to check before you go regarding the government advice travel to the country you are visiting.

Unfortunately we had a recent case where the client was traveling the day before the air corridor was open which nullifies cover for their whole trip. Also a lot of travel policies will exclude some Covid-19 exposures including cancellation and curtailment.
